The provisions set forth below are applicable to Sunset Rides, LLC (“Sunset Rides", or “we", or “us", or “our") network of websites that link to these Terms of Service (the “Agreement" or “Terms of Service") (including any versions optimized for viewing on a wireless or tablet device); email newsletters published or distributed by Sunset Rides; apps published by Sunset Rides, including the “Sunset Rides" app; or any other services, interactive features, and communications made available by Sunset Rides, regardless of how accessed and/or used, that are operated by Sunset Rides, made available by Sunset Rides, or produced and maintained by Sunset Rides and Sunset Rides’ related companies (“Services").
THESE TERMS OF SERVICE CONSTITUTE A LEGALLY BINDING AGREEMENT BETWEEN YOU AND SUNSET RIDES. BY USING OUR SERVICES, YOU ARE ACCEPTING AND AGREEING TO COMPLY WITH THE TERMS AND CONDITIONS SET FORTH HEREIN. IF YOU DO NOT AGREE TO THESE TERMS OF SERVICE, PLEASE DO NOT USE THE SERVICES. WE RESERVE THE RIGHT TO MODIFY OR AMEND THESE TERMS OF SERVICE FROM TIME TO TIME WITHOUT PRIOR NOTICE. YOUR CONTINUED USE OF OUR SERVICES FOLLOWING ANY SUCH MODIFICATIONS OR AMENDMENTS SHALL CONSTITUTE YOUR ACCEPTANCE OF THOSE CHANGES. UNLESS OTHERWISE STATED, NO CHANGES TO OUR TERMS OF SERVICE WILL APPLY RETROACTIVELY. ADDITIONALLY, CERTAIN SERVICES MAY REQUIRE YOUR EXECUTION OF SUNSET RIDES' RENTAL AGREEMENT, WAIVER OF LIABILITY AND RELEASE, AND/OR PRIVACY POLICY.
THIS AGREEMENT CONSTITUTES THE ENTIRE UNDERSTANDING AND AGREEMENT BETWEEN YOU AND SUNSET RIDES WITH RESPECT TO THE SUBJECT MATTER HEREOF. YOU ACKNOWLEDGE THAT SUNSET RIDES CANNOT GUARANTEE CONTINUOUS, UNINTERRUPTED, OR SECURE ACCESS TO ITS SERVICES, AND THE OPERATION OF THE SERVICES MAY BE INTERFERED WITH BY NUMEROUS FACTORS BEYOND SUNSET RIDES' CONTROL.
PLEASE READ THESE TERMS OF SERVICE CAREFULLY AS THEY SET FORTH YOUR LEGAL RIGHTS AND OBLIGATIONS. FAILURE TO COMPLY WITH THESE TERMS MAY RESULT IN RESTRICTIONS ON YOUR USE OF THE SERVICES.
1. Access License
Sunset Rides hereby grants you a limited, revocable, non-exclusive, and non-transferable license to access and utilize the Services and their content. This license explicitly excludes any form of resale or commercial utilization of the Services or their contents. It also prohibits the collection and use of any product listings, descriptions, or prices; the creation of derivative works based on the Services or their contents; the downloading or copying of account information for the benefit of another merchant; or the use of data mining, robots, cookies, or similar data gathering and extraction tools. Unless expressly permitted herein, neither the Services nor any part thereof may be reproduced, sold, resold, visited, or exploited for any purpose without the prior express written consent of Sunset Rides. Any unauthorized use shall automatically terminate the permissions and licenses granted by Sunset Rides to you.
2. Copyright and Ownership
All of the Content presented or exhibited in relation to the Services, including but not limited to text, graphics, photographs, images, moving images, sound, and illustrations ("Content"), is the exclusive property of Sunset Rides, its licensors, vendors, agents, and/or its Content providers. The Services, including all its components and the Content therein, are protected by trade dress, copyright, moral rights, trademark, and other intellectual property laws. The Services may solely be utilized for their intended purpose, as specified by Sunset Rides. Except as permitted by copyright law, you are prohibited from modifying any Content or materials, as well as copying, distributing, transmitting, displaying, performing, reproducing, publishing, licensing, creating derivative works from, transferring, or selling any information or work encompassed within the Services. Unless expressly authorized by the copyright laws or by Sunset Rides, you are responsible for acquiring permission before reusing any copyrighted material available on the Services. You are obligated to comply with all applicable domestic and international laws, statutes, ordinances, and regulations governing your use of the Services. The Services, Content, and all associated rights shall remain the exclusive property of Sunset Rides, its licensors, vendors, agents, and/or its Content providers, unless otherwise expressly agreed upon. Removal of any copyright, trademark, or other proprietary notices from material obtained through the Services is strictly prohibited.
3. Trademarks/No Endorsement
All trademarks, service marks, and trade names of Sunset Rides utilized herein (including but not limited to: Sunset Rides' name, Sunset Rides' corporate logo, the design of the Services, and any logos) (collectively referred to as "Marks") are either trademarks or registered trademarks of Sunset Rides, its affiliates, partners, vendors, or licensors. The use, copying, reproduction, republication, uploading, posting, transmission, distribution, or modification of Sunset Rides' Marks in any manner, including for advertising or publicity purposes related to the dissemination of materials on the Services, is strictly prohibited without the prior written consent of Sunset Rides. You are prohibited from using Sunset Rides' name or any language, pictures, or symbols that could, in the judgment of Sunset Rides, imply the endorsement of Sunset Rides in any (i) written or oral advertising or presentation; or (ii) brochure, newsletter, book, or any other written material, regardless of its nature, without the prior written consent of Sunset Rides.
4. Account Registration and Security
You acknowledge that the creation of an account is necessary to access the Services. As part of this process, you agree to: (i) provide accurate, current, complete, and truthful information about yourself as prompted by the registration, sign-in, or subscription page of the Service (referred to as "Registration Data"); and (ii) regularly update and maintain the Registration Data to ensure its accuracy, currency, completeness, and truthfulness. In the event that you provide false, inaccurate, outdated, or incomplete information, or if Sunset Rides has reasonable grounds to suspect that the provided information is false, inaccurate, outdated, or incomplete, Sunset Rides reserves the right, at its sole discretion, to suspend or terminate your account and deny any present or future use of the Services (or any part thereof) to you. You bear the responsibility for safeguarding the security and confidentiality of your password and account. Furthermore, you are accountable for all activities carried out under your account. Sharing your account information, including your username and password, with any third party or allowing any third party to access the Services using your account information is strictly prohibited. You agree to promptly notify us of any unauthorized use of your account or any other security breach related to your account that comes to your attention. It is your responsibility to adopt suitable precautions and security measures based on your specific circumstances and intended use of the Services. We reserve the right to disclose user billing, account, content, or usage records, as well as related information, under certain circumstances (such as in response to legal obligations, lawful processes, court orders, subpoenas, or warrants, or to safeguard our rights, customers, or business).
5. Solicited Submission Policy
Where Sunset Rides has explicitly requested or invited submissions or comments, Sunset Rides encourages you to submit content (e.g., comments on blog posts, participation in communities, tips, etc.) ("User Submissions") to Sunset Rides in connection with Sunset Rides' official website, https://www.sunsetrides.rent (the "Site"). User Submissions shall remain the intellectual property of the individual user. By posting content on our Site, you expressly grant Sunset Rides a non-exclusive, perpetual, irrevocable, royalty-free, fully paid-up worldwide, fully sub-licensable right to utilize, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, transmit, perform, and display such content, as well as your name, voice, and/or likeness contained in your User Submission, in whole or in part, and in any format throughout the world, using any media or technology, whether presently known or hereafter discovered. This includes all promotional, advertising, marketing, merchandising, publicity, and any other ancillary uses thereof, with the unrestricted right to sublicense such rights, indefinitely and across the universe. Any User Submissions are considered non-confidential, and Sunset Rides is not obligated to maintain the confidentiality of any information, in any form, contained in any User Submission.
6. Inappropriate User Submissions
Sunset Rides does not endorse or solicit User Submissions that arise from any activity that: (i) poses a risk of harm, loss, physical or mental injury, emotional distress, death, disability, disfigurement, or physical or mental illness to you, any other individual, or any living being; (ii) poses a risk of loss or damage to any person or property; or (iii) constitutes a crime or tort. By agreeing to these terms, you acknowledge that you have not engaged in and will not engage in any of the aforementioned activities in connection with creating your User Submission. Additionally, you understand and agree that, in relation to your User Submission, you will not inflict emotional distress upon others, publicly or otherwise humiliate others, assault or threaten others, trespass on private property without permission, impersonate any person, or misrepresent your affiliation, title, or authority. Moreover, you will refrain from engaging in any activity that may result in injury, death, property damage, diminution of value, and/or any form of liability. Sunset Rides reserves the right to reject any User Submissions that, in its sole discretion, involve any of the aforementioned activities. In the event that Sunset Rides is notified of a User Submission that allegedly violates any provision of this Agreement, Sunset Rides retains the sole discretion to determine if such violation has occurred and may remove such User Submission from the Services at any time and without prior notice.
7. Inappropriate Material
You are hereby expressly prohibited from utilizing the Services for the purpose of posting or transmitting any material that is unlawful, infringing, threatening, defamatory, libelous, obscene, pornographic, lewd, or profane in nature. Furthermore, you are strictly prohibited from posting or transmitting any material that infringes upon or misappropriates the intellectual property rights of third parties. Any usage of the Services in a manner that could potentially constitute or encourage conduct amounting to a criminal offense or a violation of any applicable law is strictly forbidden. Moreover, you explicitly acknowledge and agree that engaging in the act of sending or posting unsolicited advertisements or "spam" through the Services is strictly prohibited pursuant to this Agreement.
In addition to any available remedies Sunset Rides may possess under applicable law or equity, in the event that Sunset Rides, at its sole discretion, determines that you have violated or are likely to violate any of the aforementioned prohibitions or any applicable rules or policies set forth in this Agreement, Sunset Rides reserves the right to take any action it deems necessary to remedy or prevent such violation. This may include, without limitation, the imposition of a ban on your usage of the Services and/or the immediate removal of any materials related thereto, without any prior notice. Please be advised that Sunset Rides shall fully cooperate with any lawful requests made by law enforcement authorities or by virtue of a court order or subpoena, seeking or directing us to disclose the identity of any individual who has posted or transmitted such objectionable materials.
8. Access and Interference
You explicitly acknowledge and consent to refrain from utilizing any robot, spider, scraper, or any other automated means to gain access to the Services, for any purpose whatsoever. Furthermore, you agree not to engage in any activity that may, at the sole discretion of Sunset Rides, impose an unreasonable or disproportionately substantial burden on our infrastructure. Additionally, you shall not interfere with, or make any attempt to interfere with, the proper functioning of the Sunset Rides Site or any activities carried out on the Services. Lastly, you are strictly prohibited from circumventing any measures implemented to prevent or restrict access to the Services.
9. Right to Takedown Content
Except as explicitly stated in our Privacy Policy, we shall not engage in monitoring, editing, or disclosing the contents of a user's email or User Content posted to the Services, except under the following circumstances: (i) when it is necessary for the routine maintenance of the Services and any associated systems; (ii) when required by law; or (iii) when Sunset Rides has a good-faith belief that such action is essential to: (a) comply with applicable laws or legal processes served on Sunset Rides or the Services; (b) safeguard and defend the rights of Sunset Rides, its property, the Services, or the users of the Services; or (c) act in an emergency to protect the personal safety of our users, the Services, or the general public. Users shall bear full responsibility for the content of their messages, and Sunset Rides shall have no obligation to pre-screen any User Content. However, Sunset Rides reserves the right, at its sole discretion, to edit, refuse to post, or remove any User Content submitted to or posted on the Services, without prior notice. Without limiting the foregoing, Sunset Rides retains the right to: (i) remove any material that violates the provisions set forth herein or is otherwise objectionable; and (ii) deny access to the Services, or any portion thereof, to any user who fails to comply with any provision of this Agreement.
10. User Published Content
User published Content and User Submissions available on the Services are independent expressions and do not reflect the views of Sunset Rides or any affiliated individuals. We exercise no control over such User published Content or User Submissions. Under no circumstances should you interpret or imply Sunset Rides' endorsement of user published Content and User Submissions, whether directly or indirectly. Sunset Rides does not guarantee the accuracy or reliability of any user published Content or User Submissions disseminated through or on the Services, and we bear no responsibility or liability for any actions you may undertake based on the review of such User published Content or User Submission. By utilizing our Services, you may encounter Content that you find offensive, objectionable, detrimental, misleading, or deceptive. There are inherent risks associated with interacting with individuals who may be underage, impersonating others, engaging in international trade, or being foreign nationals. By engaging with our Services, you acknowledge and assume all associated risks.
11. Third Party Links
From time to time, the Services may contain links to websites that are not owned, operated, or controlled by Sunset Rides or its affiliates (the “Third Party Links”). These Third Party Links are provided solely as a convenience to you. By accessing the Third Party Links, you will be leaving the Services. Neither Sunset Rides nor any of its affiliates are responsible for the content, materials, or information found on or accessible through any Third Party Links or other websites. Sunset Rides and its affiliates do not endorse, guarantee, or make any representations or warranties regarding any other websites, including the content, materials, or information accessible through Third Party Links or on any other websites. Any harm or consequences resulting from your use of any other websites accessed via Third Party Links are your sole responsibility and at your own risk.
12. Transactional Partners
Occasionally, Sunset Rides may enter into partnerships with unrelated entities to jointly promote their services within our platform. In such instances, you may conduct transactions directly with the respective unrelated party. These collaborations will be clearly indicated on the relevant pages or locations, featuring the unrelated party's prominent brand and their own terms of service. By accessing and using the unrelated party's pages, you are bound by both their partner terms of service and Sunset Rides' Terms of Service. If any conflicts arise between these Terms of Service and the third party's terms of service, the third party's terms of service will govern and take precedence.
13. Termination
At our discretion, we reserve the right to suspend or terminate your access to the Services at any time, with or without cause. Furthermore, we may block your access to our Services if any of the following circumstances arise: (i) you violate these Terms of Service; (ii) we are unable to verify or authenticate the information you have provided; or (iii) we have reason to believe that your actions may result in financial loss or legal liability for Sunset Rides, yourself, or our users.
14. Representations and Warranties
You hereby confirm and warrant that: (i) you are at least 18 years of age; (ii) you possess the necessary rights and authority to enter into this Agreement; (iii) you are fully capable and competent to fulfill the terms, conditions, and obligations stated herein; and (iv) you will use the Services in complete compliance with all applicable laws. Additionally, you acknowledge that you have thoroughly read, comprehended, agreed to, and will adhere to the terms of this Agreement.
Furthermore, you warrant and guarantee that any User Submissions you provide, including all constituent elements, are either: (i) exclusively owned or controlled by you, or you possess written permission from the lawful owner of the content contained in your User Submissions, or are otherwise legally authorized to grant Sunset Rides all the rights outlined in this Agreement; and (ii) the use of your User Submissions by Sunset Rides, as described or contemplated herein, does not and will not infringe upon any copyrights, trademark rights, publicity rights, or any other rights held by any individual or entity. Your User Submissions shall not violate any laws, regulations, or rights of any kind, nor give rise to any actionable claim or liability, including but not limited to rights of publicity, privacy, and defamation.
Moreover, you acknowledge and accept full responsibility for your User Submissions and any consequences arising from their posting or publication.
15. DISCLAIMERS
YOUR USE OF THE SERVICES IS ENTIRELY AT YOUR OWN RISK. THE INFORMATION, MATERIALS, AND SERVICES PROVIDED ON OR THROUGH THE SERVICES ARE OFFERED "AS IS" WITHOUT ANY WARRANTIES OF ANY KIND, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, SECURITY, OR NON-INFRINGEMENT OF INTELLECTUAL PROPERTY. NEITHER SUNSET RIDES NOR ANY OF ITS AFFILIATES WARRANT THE ACCURACY OR COMPLETENESS OF THE INFORMATION, MATERIALS, OR SERVICES PROVIDED ON OR THROUGH THE SERVICES. IT IS POSSIBLE THAT THE INFORMATION, MATERIALS, AND SERVICES PROVIDED ON OR THROUGH THE SERVICES MAY BE OUTDATED, AND NEITHER SUNSET RIDES NOR ANY OF ITS AFFILIATES ARE OBLIGATED TO UPDATE SUCH INFORMATION, MATERIALS, OR SERVICES. PLEASE NOTE THAT THE EXCLUSIONS OF IMPLIED WARRANTIES MENTIONED ABOVE MAY NOT BE APPLICABLE IN CERTAIN JURISDICTIONS. FOR ANY SUCH PROHIBITIONS, PLEASE REFER TO THE LOCAL LAWS APPLICABLE TO YOU. NO ADVICE OR INFORMATION, WHETHER ORAL OR WRITTEN, OBTAINED FROM SUNSET RIDES OR THROUGH THE SERVICES, WILL CREATE ANY WARRANTY NOT EXPRESSLY STATED IN THIS AGREEMENT.
16. LIMITATIONS OF LIABILITY
SUNSET RIDES DOES NOT ASSUME ANY RESPONSIBILITY AND WILL NOT BE LIABLE FOR ANY DAMAGES TO YOUR COMPUTER, TELECOMMUNICATION EQUIPMENT, OR OTHER PROPERTY, OR FOR ANY VIRUSES THAT MAY INFECT THEM, ARISING FROM YOUR ACCESS TO, USE OF, OR BROWSING OF THE SERVICES, OR YOUR DOWNLOADING OF ANY INFORMATION OR MATERIALS FROM THE SERVICES. IN NO EVENT SHALL SUNSET RIDES, ITS OFFICERS, DIRECTORS, EMPLOYEES, SHAREHOLDERS, AFFILIATES, AGENTS, PROFESSIONALS, SUCCESSORS, OR ASSIGNS, OR ANY PARTY INVOLVED IN THE CREATION, PRODUCTION, OR TRANSMISSION OF THE SERVICES, BE LIABLE TO YOU OR ANYONE ELSE FOR ANY INDIRECT, SPECIAL, PUNITIVE, INCIDENTAL, OR CONSEQUENTIAL DAMAGES (INCLUDING, WITHOUT LIMITATION, THOSE RESULTING FROM LOST PROFITS, LOST DATA, OR BUSINESS INTERRUPTION) ARISING OUT OF THE USE, INABILITY TO USE, OR THE RESULTS OF USING THE SERVICES, OR THE MATERIALS, INFORMATION, OR SERVICES CONTAINED ON THE SERVICES, WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. THE LIMITATIONS OF LIABILITY STATED HEREIN MAY NOT APPLY IN CERTAIN JURISDICTIONS. FOR ANY SUCH PROHIBITIONS, PLEASE REFER TO THE LOCAL LAWS APPLICABLE TO YOU.
IN THE EVENT OF ANY PROBLEM WITH THE SERVICES, MATERIALS RELATED TO THE SERVICES, OR INFORMATION CONTAINED ON THE SERVICES, YOUR SOLE REMEDY IS TO CEASE USING THE SERVICES. IN NO EVENT SHALL THE TOTAL LIABILITY OF SUNSET RIDES TO YOU FOR ALL DAMAGES, LOSSES, AND CAUSES OF ACTION, WHETHER IN CONTRACT, TORT (INCLUDING NEGLIGENCE), OR OTHERWISE, EXCEED THE GREATER OF (A) TWENTY-FIVE DOLLARS (US $25.00), OR (B) THE AMOUNT OF FEES YOU HAVE PAID SUNSET RIDES IN THE 12 MONTHS PRIOR TO THE ACTION GIVING RISE TO THE LIABILITY.
17. Indemnity
You hereby agree to indemnify, defend, and hold Sunset Rides and its affiliated entities, as well as any associated individuals, harmless from any and all liabilities, costs, and expenses, including reasonable attorneys' fees, arising out of or in connection with the following: (i) your use of the Services or the transmission and placement of any User Submission or other content, messages, or information on the Services by you or authorized users; (ii) any violation of the terms and conditions of this Agreement, including any breach of the representations and warranties made herein; (iii) infringement upon any third party rights, including but not limited to privacy rights, publicity rights, and intellectual property rights; (iv) non-compliance with any applicable laws, rules, or regulations of the United States or any other jurisdiction; (v) any claims or damages resulting from User Submissions provided by you, including claims or damages arising from defamation or invasion of privacy; or (vi) unauthorized access and use of the Services by any party using your unique username, password, or other security credentials.
18. Release
In the event of any disputes with other users of the Services, you hereby release Sunset Rides, its officers, directors, agents, professionals, subsidiaries, joint ventures, and employees from any and all claims, demands, and damages (whether actual or consequential), of every nature and kind, known and unknown, suspected and unsuspected, disclosed and undisclosed, arising out of or in any way connected with such disputes. By releasing Sunset Rides and its aforementioned entities, you absolve them of any liability or responsibility for the aforementioned claims, demands, and damages arising from the disputes, regardless of their nature or extent.
19. Force Majeure
Neither Sunset Rides nor you shall be held accountable for damages or for any delays or failures in performance resulting from acts or occurrences beyond the reasonable control of the respective party, including, but not limited to: (i) fire, lightning, explosion, power surge or failure, water, acts of God, war, revolution, civil commotion, or acts of civil or military authorities or public enemies; (ii) any law, order, regulation, ordinance, or requirement of any government or legal body or any representative thereof; (iii) labor unrest, including, but not limited to, strikes, slowdowns, picketing, or boycotts; (iv) inability to procure raw materials, transportation facilities, or fuel; (v) energy shortages; or (vi) acts or omissions of other common carriers. These events or circumstances, which are beyond the reasonable control of Sunset Rides or yourself, shall not result in liability for damages or any performance obligations.
20. Privacy
Data collection and use, including the collection and use of personally identifiable information, is subject to Sunset Rides' Privacy Policy (accessible at https://www.sunsetrides.rent/privacy-policy), which is hereby incorporated by reference and constitutes an integral part of this Agreement.
21. General
Any claim relating to, and the use of, these Services and the materials contained therein, is governed by the laws of the State of Florida. You consent to the exclusive jurisdiction of the state and federal courts located in Collier County, Florida. A printed version of these Terms of Service will be admissible in judicial and administrative proceedings based upon, or relating to, these Terms of Service to the same extent and subject to the same conditions as other business documents and records originally generated and maintained in printed form.
22. DIGITAL MILLENNIUM COPYRIGHT ACT (“DMCA”) NOTICE
In operating the Services, Sunset Rides may function as a "services provider" as defined by the Digital Millennium Copyright Act (DMCA), offering online materials and links to third-party websites. Consequently, the Services may transmit, store, access, or make available third-party materials that are not owned or controlled by Sunset Rides. To address copyright infringement allegations on the Services, Sunset Rides has implemented legally mandated procedures.
Sunset Rides has adopted a policy that allows for the removal of infringing content or the potential suspension of users who engage in the following activities: (i) repeated infringement of the rights of Sunset Rides or a third party, (ii) violation of intellectual property laws or regulations, or (iii) violation of any terms and conditions outlined in this Agreement. If you believe that any material available through the Services infringes your copyright, you should notify us using the notice procedure for claimed infringement under the DMCA (17 U.S.C. Sect. 512(c)(2)). We will make reasonable efforts to promptly remove or disable access to the allegedly infringing material and follow the DMCA procedures to resolve the claim between the notifying party and the alleged infringer who provided the content.

Identification of the intellectual property that you claim has been infringed.
Sufficient detail to enable us to locate the allegedly infringing material on the Services.

Sunset Rides may notify users of any infringement notice through general notices on the Services, email to a user's email address on record, or written communication sent by first-class mail to a user's physical address on record. If you receive such an infringement notice, you may provide a counter-notification in writing to the designated agent. The counter-notification should include the following information:
Identification of the material that has been removed or to which access has been disabled, along with its previous location on the Services.
A statement, made under penalty of perjury, that you have a good faith belief that the material was removed or disabled as a result of a mistake or misidentification.
Your name, physical address, and telephone number, along with a statement consenting to the jurisdiction of a Federal District Court for the judicial district where your physical address is located. 23. Severability
